Woman fined RM6,000 for abusing, possessing drugs

KUCHING: A jobless woman was fined RM6,000 in default of eight months by the Magistrates’ Court today (Nov 22) for two counts of drug abuse and possession in July this year.

The accused Sofina Sar Gandang, 30, pleaded guilty to two charges read out by an interpreter in front of Senior Assistant Court Registrar Sandy Yvette Freddy.

According to the first charge sheet, she was charged with possessing 0.48g of Nimetazepam in the Sarawak Narcotics Criminal Investigation Department (NCID) toilet around 6pm on July 18.

Therefore, the accused is prosecuted under Section 12 (2) of the Dangerous Drugs Act 1952 and read together with Section 12 (3) of the same Act, which carries a fine up to RM100,000 or a jail term of up to five years or both, if convicted.

Sandy meted out a fine of RM3,200 in default of five months in jail if the accused failed to pay the fine.

In addition, the accused is also prosecuted under Section 15 (1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 15 (1) of the same Act, for being involved in drug abuse activities.

A fine of up to RM5,000 or a jail term of up to two years, can be imposed upon conviction.

For the second charge, she was charged with injecting methamphetamine and amphetamine into her body.

Because of that, the accused was fined RM2,800 in default of three months in jail and be placed under police supervision for two years after serving the prison sentence or paying the fine.

The prosecution of the case was handled by Insp Nur Syafiqa Nyaie Ilin while, the accused was unrepresented by a counsel.
