KUCHING: Head of State (TYT) Tun Pehin Sri Dr Wan Junaidi Tuanku Jaafar has called for the strict adherence to the principle of separation of powers to ensure the independence and effectiveness of the Syariah judiciary.
He stressed that this principle would allow the Syariah Court to enforce Islamic laws more effectively, building greater confidence among Muslims in Sarawak in the fairness and transparency of the state’s Syariah legal system.
Wan Junaidi said that the separation of powers between the executive, legislative and judiciary is essential to ensure that each branch of government functions independently, without interference or influence from others.
“Ensuring the independence of the Syariah Court is critical for fair, just decisions based on Islamic law.
“This approach will strengthen public trust in the judiciary and the integrity of the system. Therefore, I urge all parties to respect this principle of separation of powers to establish an independent Syariah judiciary system.”
Wan Junaidi said this during the opening of the Syariah Legal Year at Dewan Majma’ Tunku Abd Halim Mu’adzam Shah today (Jan 21).
He also stressed the need for reforms in the Syariah judiciary, including enhancing the capabilities of judges and officers, improving case management through technology, and updating laws to meet current needs.
He expressed support for the expansion of the Syariah Court hierarchy in Sarawak to include a Syariah Supreme Court, as seen in other states like Perak and Sabah.
Wan Junaidi expressed optimism that Sarawak’s Syariah judges, with their deep understanding of the local socio-cultural context, are well-equipped to make fair and inclusive decisions that reflect the needs of the community.
