Two companies fined for flouting Act

SIBU: A trading company was fined RM3,500 by the Magistrate’s Court yesterday for contravening Employees’ Social Security Act 1969.

The fine was imposed by Magistrate Oon Kork Chern after the company’s representative entered a guilty plea.

The charge against the company located at Teku stated that as a principal employer to an employer had failed to register her within one month from the month of employment as required under Section 5, Employees’ Social Security Act 1969 and Regulation12, Employees’ Social Security (General) Regulations 1971.

As such it had committed an offence under Section 94(g), Employees’ Social Security Act 1969 (Act 4) which shall be punishable under Section 94, of the same Act.If found guilty under the Act, the punishment provides for an imprisonment term which may extend to two years or with fine not exceeding RM10,000 or both.

Prosecuting Officer Sylvester Candy Pai from the Social Security Organisation (SOCSO) told the court that on June 13 last year at around 11.19 am, an inspection was conducted by SOCSO’s inspector Awang Abdul Razzaq Awang Kaderi at the company’s premises in Teku.

Following the inspection it was found that the company had failed to register an employee within one month from the month of employment as she had started her employment on Feb 1, 2022.

In a separate case heard at the same Court, a timber company in Jalan Salim was fined RM3,000 for failure to pay interest on contribution in arrears to SOCSO within the stipulated period.

According to the charge against the company, the principal employer had failed to pay to SOCSO, the interest on contribution in arrears totalling RM1,593 for the period from Aug 2014 until June 2016, with 14 days from the date of the reminder notice of demand sent by SOCSO as stipulated under Section 14A, Employees’ Social Act 1969 and Regulation 33, Employees’ Social Security (General) Regulations 1971.

As such it had committed an offence under Section 94(a), Employees’ Social Security Act 1969 (Act 4) and punishable under Section 94, of the same Act.

Both companies paid the fines.
