Telco customers on six-month peace bond over defamatory Facebook post

KUCHING: The Magistrates’ Court here has ordered two customers of a telecommunications company to be placed on a six-month peace bond for uploading defamatory posts on Facebook.

Liew Siaw Hui, 24, and Vong Tse Fui, 51, admitted to the charge under Section 67 of the Criminal Procedure Code when it was read before Magistrate Syarifah Fatimah Wan Ali on Thursday (Feb 27).

According to the case facts, on Oct 16, 2024, at around 6pm, a female complainant, who owns the company, discovered a social media post from an anonymous user accusing her business of fraud involving the conversion of Umobile network numbers to CelcomDigi.

Suspecting the individuals behind the post to be Liew and Vong — both of whom had previously disagreed with the company over a network switching promotion — she lodged a police report for further action.

Investigations found that on Aug 24, 2024, Vong had visited the complainant’s shop in Batu Kawa and opted to switch from CelcomDigi to Umobile due to a promotion offering lower monthly payments.

An employee allegedly assured Vong that Umobile’s 5G network was the best in MJC, Batu Kawa.

However, about two months later, on Oct 8, Vong and Liew returned to the shop to switch back to CelcomDigi, claiming the Umobile network was weak and did not match the employee’s claims.

The network switching process could not be processed as they had to settle their outstanding bill first, leading to their dissatisfaction.

Following that, they uploaded a Facebook post about the incident, which the complainant claimed was defamatory and damaging to her company’s reputation.

To prevent a recurrence, the court placed both individuals on a six-month peace bond with RM300 bail, without deposit.

ASP Arman Ibrahim prosecuted the case while the two were unrepresented by counsels.
