Teen pleads guilty to raping 12-year-old girlfriend

KUCHING: In the Sessions Court on Wednesday (Jan 10), a 19-year-old teen pleaded guilty to raping his 12-year-old girlfriend in December of last year.

The accused admitted guilt as soon as the charge under Section 376(1) of the Penal Code was read before Judge Afidah Abdul Rahman.

The charges state that he is accused of raping a 12-year-old girl under the stairs of a flat in Kuching at about 2.30am on Dec 10, 2023.

If convicted, the accused could face a sentence of up to 20 years in prison and whipping.

Judge Afidah ordered the accused to be remanded pending the completion of a social report, scheduled for February.

Details of the case reveal that the complainant is the victim’s grandmother, who was informed by the victim that she had engaged in sexual activity with her boyfriend under the stairs of a flat at approximately 2.30am on Dec 10, 2023.

Subsequently, the victim underwent a hospital examination where an obstetrician and gynaecologist confirmed a tear in the hymen on the victim’s genitals.

A police report was filed by the complainant, leading to the arrest of the accused after further investigation revealed that the victim, aged 12 years and 11 months, had been raped.

Deputy public prosecutor Iezzah Iburdanisha Ibrahim handled the prosecution of the case while the accused did not have legal representation.
