Jailed for fatal shooting of friend during hunting trip

KUCHING: A 38-year-old man was jailed one month by the Magistrate’s Court here today (May 3) for accidentally shooting his friend dead while hunting wild boar in Kampung Sungai Beradek.

Roy Panyie, from Kampung Melaban, Samarahan pleaded guilty to two charges which were read before Magistrate Syarifah Fatimah Azura Wan Ali.

According to the first charge, Roy, who works as a lorry driver, is charged under Section 304A of the Penal Code for causing death by negligence of a 44-year-old male victim.

Roy allegedly accidentally shot the victim with a shotgun while hunting in a jungle in Kampung Sungai Beradek, at around 9 am on April 27.

If convicted, Roy can be punished with imprisonment of up to two years or a fine or both.

Magistrate Syarifah Fatimah Azura Wan Ali sentenced him to one month in prison and a fine of RM3,000 in default four months in prison for the first charge.

As for the second charge, he was charged under Section 8(a) of the Arms Act 1960 for being in possession of a shotgun without a valid license.

For that offence, he was sentenced to a fine of RM1,000 or two weeks in jail.

Based on the facts of the case, on April 26, at around 4.30 pm, the accused and the victim went out at night to hunt for wild boar.

On April 27, around 9 am, while they were tracking for wild boar, the victim asked the accused to hold his shotgun.

However, unfortunately when the accused pulled the trigger, the shot went off and hit the victim.

Roy was in a state of panic, and sought immediate help from others.

A police report was made and the victim’s body was taken to the hospital for further action.

The results of the investigation, based on the pathology report, confirmed the wound in the chest was caused by gunshots in the incident.

In addition, the weapon used by Roy was also confiscated and the report confirmed that the gun was not licensed.

Prosecuting Officer Inspector Ammarsoffi Yusoff prosecuted the case while the accused was not represented by a legal counsel.
