KUCHING: The Magistrate Court here fined a fisherman RM4,500, in default 10 months in prison, for drug abuse and splashing red paint on the fence of a house owned by a 37-year-old man.
Mohammad Sofian Jais, 37, pleaded guilty before Magistrate Mason Jaro Lenya Barayan to two charges, read out by an interpreter.
The first charge accused him and an accomplice, who remains at large, of damaging a stainless-steel fence and veranda tiles, causing a loss of RM300.
This incident took place at Tabuan Jaya Baru, Jalan Stutong, around 2.53 am on January 25.
As a result, Sofian faced charges under Section 427 of the Penal Code, and read together with Section 34 of the same Code.
For this offence, Mason fined him RM1,500 in default two months in prison.
The case details revealed that the homeowner discovered the front of his house vandalised with red paint, alongside a plastic bag containing oil and stones, and a burning plastic bottle filled with oil.
A police report was promptly filed, leading to Sofian’s arrest at a house in Jalan Arang around 5.30 pm on January 28.
CCTV footage confirmed Sofian as the individual who splashed red paint on the complainant’s house.
It was revealed that he did not know the homeowner and had been instructed by someone to commit the act as a warning related to a debt.
The second charge, pertaining to drug abuse, resulted in a RM3,000 fine for Sofian, in default eight months in prison, for abusing amphetamine and methamphetamine.
He was prosecuted under Section 15 (1)(a) of the Dangerous Drugs Act 1952, which is punishable under Section 15 (1) of the same Act.
Inspector Merylene Lindan Andrew Mang, prosecuting, urged for a sentence that would serve as a deterrent to Sofian.
