KUCHING: The Sessions Court here sentenced a 33-year-old man to eight years in prison and three lashes of the cane for exposing his younger sister to pornographic materials on a smartphone.

Judge Iris Awen Jon meted out the sentence after the accused pleaded guilty to a charge framed under Section 15(e) of the Sexual Offences Against Children Act 2017, punishable under Section 15 and read together with Section 16 (1) of the same Act.

Upon conviction, he can be sentenced to an imprisonment of up to 10 years or a fine up to RM20,000 or both.

He committed the offence at their residence in a village in Padawan at around 8.30 pm on Sept 20, 2023.

According to the facts of the case, the man showed his 13-year-old younger sister a pornographic video of two men stroking their genitals while the victim was getting water at the kitchen of their house.

He ordered his sister to replicate the actions depicted in the video.

But she refused and went to the living room where, the brother persisted and showed her the same pornographic video and ordered her to follow the act.

Frightened, the sister sought help from their neighbour and with the neighbour’s help, a police report was filed, which led to her brother’s arrest.

Investigations found that the accused had shown pornographic materials to a 13-year-old child and ordered the victim to mimic the acts depicted in the video on his genital.

Deputy public prosecutor Ruvinasini Pandian prosecuted the case while, the offender was unrepresented by a counsel.
