Duo fined RM3,000 each for house-breaking and theft

KUCHING: Two accomplices were each fined RM3,000 in default 12 months’ imprisonment by the Magistrates’ Court here for breaking into a house and stealing a laptop worth RM1,500 on December 1. 

Farhan, 26, and Safwan, 26, pleaded guilty to the charge read before Magistrate Mason Jaro Lenya Barayan. 

According to the facts of the case, both were jointly charged under Section 457 of the Penal Code, read together with Section 34 of the same code, for breaking into the home of a 49-year-old woman and stealing a laptop. 

The offence occurred at a house on Jalan Matang at around 3 am on December 1. 

On the day of the incident, the complainant woke up to find an unknown man attempting to take her mobile phone. She screamed for help but the two suspects managed to escape through the kitchen door with her child’s laptop. 

One of the suspects left his motorcycle near the complainant’s house during the escape.

A police report was lodged, leading to the arrest of both suspects later that morning at Kampung Gersik at around 10.30 am. 

Investigations revealed that the duo had broken into the house and stolen the laptop worth RM1,500. CCTV footage captured their actions and one of the suspects left his identification documents inside the victim’s house. 

Shockingly, the first suspect, Ahmad Farhan, was revealed to be the victim’s nephew. The stolen property from the break-in was shared with his accomplice. 

In the same court, Ahmad Farhan was sentenced to six months’ imprisonment for disposing of a stolen motorcycle belonging to a 22-year-old man by selling it to another person. 

According to the charge sheet, he committed the offence at a self-service laundromat in Kubah Ria at around 11 am on December 6. 

He was charged under Section 414 of the Penal Code, which provides for imprisonment of not less than six months and up to seven years, and caning, upon conviction.
